Trump’s legal team, in these cases, emphasized his role as a presidential candidate, asserting that the harm being contested was against him as a candidate, not in his capacity as the incumbent president.

This emphasis on Trump’s role as a candidate directly contradicts the argument of presidential immunity for actions taken in an official capacity, undermining the defense’s logic. Brown argues that this contradiction weakens Trump’s claim to any form of immunity related to his actions as president.

Brown expresses skepticism about the likelihood of the appeals court ruling in Trump’s favor, predicting that similar arguments would resurface if the case reaches the Supreme Court. He suggests that Trump’s efforts to shift the narrative and legal strategies reveal his concern about facing a trial with Smith, especially as the November timeline looms.
