Donald Trump’s team is actively developing strategies to prevent him from being incarcerated, particularly if his public comments continue to violate legal boundaries amid his criminal trial. The urgency within his circle intensified after a New York Judge, Juan Merchan, found the former president in contempt of court.

This decision came on a Tuesday, resulting in a hefty $9,000 fine against Trump for his repeated breaches of a court-imposed gag order. This has escalated concerns among his allies and advisors about the possibility of jail time to enforce compliance.

Rolling Stone magazine has reported, citing two sources familiar with the ongoing discussions, that Trump’s team is contemplating what they have termed the “jailbreak” strategy. This approach involves filing an emergency writ of habeas corpus, which Trump’s advisors believe would secure an emergency stay of the contempt order, effectively pausing any immediate risk of jail time.

They are confident that this legal maneuver would be upheld, staving off the logistics of incarcerating a former president who is constantly accompanied by an armed Secret Service detail. The specter of imprisonment has reportedly unnerved Trump, particularly the prospect of wearing an orange jumpsuit typical of inmates.

However, reassurances have been made to him by at least one of his lawyers that he would not be required to don such attire during his criminal trial, even if he were to be remanded. While Trump’s lead attorney, Todd Blanche, has refrained from commenting on this specific strategy, Trump’s legal spokeswoman, Alina Habba, has been vocal.

She criticized the gag order imposed by Judge Merchan as a political maneuver, aiming to undermine Trump’s visibility as the presumptive Republican nominee for the upcoming elections. According to Habba, the campaign has even leveraged this situation to fundraise, telling supporters that Trump is being unjustly “silenced.”

Habba further articulated that the allegations against Trump and the subsequent gag order are perceived as tactics of election interference. She expressed a strong belief that the truth would ultimately come to light and vindicate the former president. This ongoing saga underscores the complex interplay of legal strategies, political campaigning, and personal anxieties surrounding the former president.

As Trump’s team navigates the judicial landscape, the potential for him to face jail time adds a significant layer of tension to his campaign efforts and public engagements. The unfolding events continue to attract significant media attention, with stakeholders closely monitoring each development for its implications on Trump’s future and the broader political climate.
