Attorney Vows Legal Fight Against Trump’s Executive Order Targeting Voting Rights

Prominent voting rights attorney Marc Elias issued a stark warning Wednesday about President Donald Trump’s latest executive order aimed at altering U.S. election procedures, promising aggressive legal action in response.

Elias, founder of the advocacy group Democracy Docket, made the comments during an interview on MSNBC, where he expressed deep concern over the implications of Trump’s order, which critics argue threatens the integrity of future elections, including the pivotal 2026 midterms.

“There’s no question that 2026 is under attack,” Elias said. “I don’t think Donald Trump is going to be able to cancel the elections, but I do think he wants to attack free and fair elections in every way he can.”

While Elias characterized the executive order as “bluster” and “performance art,” he warned that its underlying intention is dangerous. “This is a five-alarm fire,” he said. “This executive order is a ham-handed way that the fire is being lit.”

The attorney emphasized that Trump’s latest move may lack legal foundation but is nonetheless part of a broader strategy to sow chaos and fear within the democratic process.

“It’s going to be quite alarming and quite surprising to many people to see how far he’s willing to go,” Elias said. “This executive order itself is sort of a fever dream, right? He doesn’t have the authority to do the things he claims to do, but he is going to try to bully and intimidate his way.”

Elias, who has led multiple legal battles defending voting rights across the country, made clear that the order would not go unchallenged. “He is going to face lawsuits, I can promise him that, and he’s going to lose those cases,” Elias stated confidently.

One particularly troubling element of the order, according to Elias, is the effort to empower partisan actors to determine voter eligibility and ballot validity.

“This desire on their part to deputize their folks, to decide whether you get to vote and whether your vote counts is a real problem,” he warned. “And I can promise everyone that it is one I take seriously, my team takes seriously, lots of others take seriously, and we will litigate aggressively.”

Elias concluded by cautioning Americans to prepare for a wave of unprecedented election challenges. “We all need to be steeled for that reality,” he said, “because the thing he fears most is that he will be held accountable at the ballot box.”
