9-Month-Old Baby Severely Burned in Scalding Bath at Georgia Daycare – Mother Sues

A Georgia mother is taking legal action against a daycare center after her 9-month-old son suffered severe burns while in their care. Share Besley’s infant, Virgil, endured months of painful recovery after being placed in a scalding hot bath by a worker at Young Mindz Learning Academy. The incident, captured on surveillance video, has sparked outrage and a lawsuit aimed at holding the facility accountable.

According to Besley, the worker left Virgil in the hot water for over three minutes, causing significant injuries. “I had to watch them pop his blisters; no amount of pain medicine could help him,” she told WSB-TV. The footage, shared exclusively with the outlet, shows the worker aggressively removing the baby’s clothing before placing him in a sink filled with water. It wasn’t until she removed Virgil that she realized he was in pain, prompting her to panic and run around the facility for more than 15 minutes.

Besley’s lawsuit alleges that the employee violated daycare policy by bathing Virgil instead of using wet wipes, as required. “They were supposed to use wet wipes,” said her attorney, Michael Neff. “I just never in a million years thought something like this would happen,” Besley added.

The Georgia Department of Early Care and Learning conducted a three-month investigation following the incident. The state found that the employee’s actions were detrimental to the child’s well-being and revealed additional violations at the facility. Children under three years old were not separated from older kids, as mandated by regulations. A young child can be seen in the video looking over Virgil after he was burned.

“This is a multi-level fail on the business,” Neff said. Although the daycare has since corrected its violations and is in good standing with the state, the employee involved was arrested and charged with cruelty to children. She was sentenced to probation.

Besley, however, remains determined to seek justice for her son. “I feel like nobody’s done anything to try and make it right for him; he needs justice,” she said. The lawsuit underscores the importance of accountability and safety in child care facilities, as parents continue to grapple with the fear of similar incidents.
